    Terms of Service

    These Terms of Service ("Terms") govern your access to and use of the website, applications, online driver education courses, and related services provided by Bitten Development Agency LLC, doing business as Learn Driver ("Learn Driver", "we", "us", or "our"), including all content, features, and functionality offered through them (collectively, the "Services").

    By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

    1. Acceptance of Terms

    1.1 These Terms form a binding agreement between you and Learn Driver. Your use of the Services, including creating an account, enrolling in a course, or accessing any content, constitutes your acceptance of these Terms.

    1.2 Learn Driver may also publish a separate Privacy Policy describing how we collect, use, and disclose personal information. The Privacy Policy is incorporated by reference into these Terms. By using the Services, you acknowledge that you have read and understand the Privacy Policy.

    2. Eligibility and Accounts

    2.1 Eligibility. You must be at least fourteen (14) years of age to use the Services. The Services are intended for individuals located in the United States. If you are under the age of eighteen (18), you represent that you have obtained permission from a parent or legal guardian to use the Services and to agree to these Terms.

    2.2 Account Registration. To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

    2.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at privacy@learndriver.com if you suspect any unauthorized use of your account.

    2.4 Use on Behalf of a Minor. If you are a parent or legal guardian permitting a minor to use the Services, you are responsible for the minor's activities and for ensuring that the minor uses the Services in compliance with these Terms and applicable law.

    3. Courses, Certificates, and Regulatory Requirements

    3.1 Course Availability. Courses, modules, and content offered through the Services may vary by state and regulatory requirements. Learn Driver does not guarantee that any particular course will satisfy all requirements in your jurisdiction. You are responsible for confirming the applicable requirements with your local licensing authority.

    3.2 Course Completion. To qualify for course completion or certification, you must meet all requirements specified in the course, including any time-on-test, assessment, and identity verification requirements.

    3.3 Certificates. Upon successful completion of applicable requirements, Learn Driver may issue a certificate or other evidence of completion. The form and timing of such certificates may be determined by regulatory rules and by Learn Driver in its discretion.

    3.4 Reporting to Agencies, Driving Schools, and Insurers. Where required or permitted by law or by program rules, Learn Driver may automatically report course completion and related data to state agencies, approved driving schools, and insurance partners.

    3.5 No Guarantee of Licensing. Learn Driver does not issue driver licenses and does not control the decisions of state licensing authorities. Successful completion of a course does not guarantee that you will receive a license or other credential.

    4. Payments, Billing, and Refunds

    4.1 Fees. Certain Services, including course enrollments, may require payment of fees. The price and any applicable taxes will be disclosed at the time of purchase. By submitting payment information, you authorize Learn Driver and its payment processor to charge the applicable amounts.

    4.2 Payment Processing. Payments are processed by third-party providers such as Stripe. Learn Driver does not store full credit card numbers or CVV codes. Your use of third-party payment services may be subject to additional terms and conditions imposed by those providers.

    4.3 Subscriptions and Recurring Billing. Learn Driver may offer subscription or recurring billing options in the future. If you enroll in a subscription, you authorize recurring charges until you cancel in accordance with the instructions provided at the time of enrollment. We will provide information about how to cancel a subscription before your first recurring charge.

    4.4 Refunds. Unless otherwise stated at the time of purchase or required by law, all fees are non-refundable once you have accessed course materials or have been issued a certificate. Learn Driver may, in its sole discretion, provide a refund or credit in limited circumstances.

    5. Third-Party Services and Integrations

    5.1 The Services may integrate with or rely on third-party services, including Supabase (authentication and data storage), Stripe (payment processing), Google Places (address validation), Resend (email delivery), Vercel (hosting and analytics), Mux (video streaming), and others.

    5.2 These third-party services are operated by independent entities and may be subject to their own terms and privacy policies. Learn Driver is not responsible for the content, availability, or performance of third-party services.

    6. Acceptable Use

    6.1 You agree that you will not, and will not permit any third party to:

    • Use the Services for any unlawful, fraudulent, or malicious purpose;

    • Misrepresent your identity, age, or eligibility, or impersonate any person or entity;

    • Circumvent, disable, or otherwise interfere with security or integrity features of the Services;

    • Copy, distribute, modify, or create derivative works of course content except as expressly allowed by these Terms;

    • Access or attempt to access another user's account without authorization;

    • Use automated means (such as bots or scrapers) to access the Services except as explicitly allowed by Learn Driver in writing;

    • Upload or transmit any viruses, malware, or harmful code.

    6.2 Learn Driver reserves the right to investigate and take appropriate action, including suspension or termination of access, for violations of this Section.

    7. Intellectual Property

    7.1 Ownership. All content, materials, and technology made available through the Services, including text, graphics, logos, videos, course content, software, and designs, are owned by Learn Driver or its licensors and are protected by intellectual property laws.

    7.2 Limited License. Subject to your compliance with these Terms, Learn Driver grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and course materials solely for your personal, non-commercial educational purposes.

    7.3 Restrictions. You may not reproduce, distribute, publicly display, or perform, or otherwise exploit the Services or any content, except as expressly permitted in these Terms or with prior written consent from Learn Driver.

    8. Disclaimers

    8.1 General Disclaimer. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

    8.2 No Guarantee of Results. Learn Driver does not guarantee that completion of a course will result in the issuance of a driver license, insurance discount, or any other outcome. Decisions regarding licensing and related benefits are made by third-party authorities and organizations.

    9. Limitation of Liability

    9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LEARN DRIVER OR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF LEARN DRIVER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    9.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARN DRIVER'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LEARN DRIVER FOR THE COURSE OR SERVICE GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

    10. Indemnification

    You agree to indemnify, defend, and hold harmless Learn Driver and its owners, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any applicable law or the rights of any third party.

    11. Suspension and Termination

    11.1 Learn Driver may, in its sole discretion and without prior notice, suspend or terminate your access to the Services if it believes you have violated these Terms, engaged in fraudulent or illegal activity, or created risk or possible legal exposure for Learn Driver or others.

    11.2 Upon termination, your right to use the Services will immediately cease. Certain provisions of these Terms that by their nature should survive termination (such as disclaimers, limitations of liability, and indemnification) will remain in effect.

    12. Governing Law and Dispute Resolution

    12.1 These Terms and any dispute arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to its conflict of law principles, while recognizing Texas-specific regulatory obligations for certain driver education programs.

    12.2 Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

    13. Changes to These Terms

    Learn Driver may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page and may provide additional notice, such as by email or through the Services. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
